ANSWERS:

Q: Who can be a candidate?

A: A person who is qualified to be a voter in the City of Kingston's 2010 municipal elections is also eligible to be a candidate for office. That means, on the day you are nominated, you must be qualified to hold that office. Candidates for the offices of Mayor and Councillor must meet the same criteria as eligible voters or electors. A candidate for school board trustee must reside within the board area and be a supporter of that board.

You must be:

  • a resident of the City of Kingston, a non-resident owner or tenant of land in the municipality or spouse of such non-residential owner or tenant;
  • a Canadian citizen;
  • at least 18 years old;
  • not prohibited from voting by law; and
  • not disqualified by any legislation from holding municipal office.

In order to be considered for declaration as a legally qualified municipal candidate, you must file a Nomination Form and a Declaration of Qualifications for the City of Kingston 2010 Municipal Election. If you are a candidate for Mayor or Councillor, you will file Declaration of Qualifications — Form 54A. If you are a candidate for School Board Trustee, you will file a Declaration of Qualifications — Form 54B.

Q: What offices are to be elected?

A: The offices to be elected are:

  • Mayor
  • Councillors (1 for each of the 12 districts)
  • School Board Trustees: Based on 2006 representation, further notice will be published once final representation has been confirmed for 2010.
    • English Public - Limestone District School Board (5 trustees)
      1. Countryside, Pittsburgh , and Frontenac Islands
      2. Loyalist-Cataraqui, Collins-Bayridge, Lakeside
      3. Portsmouth and Trillium
      4. Cataraqui, Kingscourt-Strathcona and Kings Town

Q: Where can I obtain a Nomination Kit?

A: Nomination Kits are available from the Election Office at City Hall, 216 Ontario Street. The kits contain candidate information and forms, including the Declaration of Qualifications form, the Nomination Paper form, Notice of Penalties, and the Preliminary Certificate of Maximum Campaign Expenses as of the filing date. While candidates may download these forms from this web site, it is recommended you obtain a Nomination Kit from the Election Office to ensure you have all the necessary information.

Q: Where can I obtain and file a Nomination Paper?

A: You must also file a Nomination Paper and Declaration of Qualifications, which are available on this Web site or from the Election Office, Kingston City Hall, 216 Ontario Street, Monday through Friday, 8:30 a.m. to 4:30 p.m. Nominations must be filed in person, or by an agent acting on behalf of the nominee, at the Clerk's Department. *It is recommended that a nomination kit be picked up at the Election Office as the kit contains additional information that you cannot download from this site.

The Nomination Paper may be filed at the Election Office until Thursday, September 9, 2010, between 8:30 a.m. and 4:30 p.m., and on Nomination Day, Friday, September 10, 2010 between 9 a.m. and 2 p.m.

Nomination Papers require a commissioner's signature. A Commissioner of Oaths is available in the Election Office or Clerks Department at City Hall.

Q: What information must be included on the Nomination Paper?

A: The candidate's Nomination Paper must include the candidate's name, address, telephone number and the office for which he or she wishes to be nominated.

Q: Is there a cost to file a Nomination Paper?

A: A filing fee of $200 for the mayoralty candidate and $100 for all other candidates is required at the time of nomination. Please note that the fees shall be paid by cash, certified cheque or money order. Please make certified cheques payable to the Corporation of the City of Kingston.

Q: How do I withdraw my nomination?

A: If a candidate wishes to withdraw his or her nomination, he or she must notify the Clerk in writing no later than 2 p.m. on Nomination Day (September 10, 2010)

Q: When is Nomination Day?

A: Nomination Day is Friday, September 10, 2010. On Nomination Day, Nomination Papers will be received at the Election Office between 9 a.m. and 2 p.m. No Nomination Papers will be accepted after 2 p.m. on Nomination Day.

Q: How Much Am I Allowed to Spend on My Campaign?

A: The Municipal Election Act requires that the Clerk provide each candidate with an estimated spending limit upon filing of nomination papers. The estimate is calculated based on the number of electors in the previous election.
