PUBLIC NOTICE OF COMPLETE APPLICATION AND PUBLIC MEETING

June 17, 2010 at 6:30 p.m.
Council Chambers, City Hall, 216 Ontario Street

NOTE: All Public Meetings are scheduled for 6:30 p.m. and more than one meeting may have been scheduled for this time. The meetings will occur in the order as shown on the Committee's Agenda, each commencing as soon as the previous Public Meeting concludes. Re: Proposed Official Plan Amendment under Section 17 of the Planning Act — to designate properties on the north side of Princess Street municipally addressed from 1293 Princess Street to 1343 Princess Street the "Princess Street-Alexander Street Site Specific Policy Area" in the City of Kingston Official Plan.

An application for Official Plan Amendment has been submitted by the City of Kingston for the properties along the north side of Princess Street from McMichael Street to the properties abutting Indian Road, which are municipally addressed from 1293 Princess St. to 1343 Princess St. (see Key Map). 11 properties will be affected. The properties are currently designated 'Arterial Commercial' in the City of Kingston Official Plan.

The purpose of the application is to re-designate a site-specific policy area in order to implement the "Alexander Street Policy Area" policies from the former City of Kingston Official Plan. An administrative oversight resulted in its exclusion from the original adoption of the 2010 City of Kingston Official Plan. The intent of the application is to re-insert these policies into the Official Plan. The site-specific policies provide criteria for development proposals intending to convert the existing residential uses to arterial commercial uses. Some of these criteria apply to permitted uses, location of the development, buffering, landscaping, vehicular access, parking, etc.

ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of or in opposition to the proposed Official Plan Amendment. The Committee will receive a Comprehensive Report at the regular agenda component of a future Planning Committee meeting at which time a recommendation will be made to Council regarding the amendment.

If a person or public body does not make oral submissions at a Public Meeting or make written submissions to the City of Kingston before the application is approved, the person or public body is not entitled to appeal the decision of the City of Kingston to the Ontario Municipal Board. If a person or public body does not make oral submissions at a Public Meeting or make written submissions to the City of Kingston before the Bylaw is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

PLEASE TAKE FURTHER NOTICE as the Planning Committee has been delegated by Council to hold the Public Meeting instead of Council, that all representation, both oral and in writing, shall be considered only by the Planning Committee. It is the Committee's Report which will be considered by Council.

Additional information relating to the proposed Official Plan Amendment is available for inspection between 8:30 a.m. and 4:30 p.m., Monday to Friday from the date of this Notice to the date of the Public Meeting at the Office of the Director, Planning and Development at the Municipal Building, 1211 John Counter Boulevard, or enquiries may be made by telephoning Calvin Chan, Planner, 546-4291 ext. 3126.

NOTICE OF COLLECTION - Personal information collected as a result of this public hearing is collected under the authority of the Municipal Act, the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), the Planning Act, and all other relevant legislation, and will be used to assist in making a decision on this matter. All personal information (as defined by MFIPPA), including (but not limited to) names, addresses, opinions and comments collected will be made available for public disclosure to members of the public, at the meeting, through requests, and through the website of The Corporation of the City of Kingston.
