Notice of a public meeting and complete planning application regarding a proposed Zoning Bylaw amendment affecting parking provisions

July 14, 2015 -

A public meeting will be held on Thursday, Aug. 6, at 6:30 p.m. in the Council Chamber, City Hall, 216 Ontario St.

Purpose and effect of the application: The parking provisions are being modified to ensure that the non-residential parking provisions apply to non-residential uses in the "A" zones in Zoning Bylaw 8499. The "A" zones are low density residential zones for one-family and two-family dwellings, that also permit non-commercial uses such as: libraries, art galleries, museums, public and private day schools, community halls, churches, church halls, institutions or homes operated or supervised by the Children's Aid Society. The amendment will ensure that the applicable parking provisions apply to these non-residential uses.

No new standards are being created. The existing parking standards will not be altered and the various "A" zones are not proposed to change. This amendment will provide clarification regarding the non-residential parking standards that are to be applied to non-residential uses.

Address of property: The changes do not affect any specific site. The "A" type zones are located though out the area covered by Zoning Bylaw No. 8499, in the central area of the City. Therefore, no map or address is provided.

Public consultation: Anyone may attend the public meeting and make a verbal statement, and/or submit comments in writing, either in support of or in opposition to the proposed Zoning Bylaw amendment. If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Kingston before the proposed Zoning Bylaw amendment is passed, the person or public body is not entitled to appeal the decision of the council of The Corporation of the City of Kingston to the Ontario Municipal Board.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the City of Kingston before the Zoning Bylaw amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the board, there are reasonable grounds to do so.

If you wish to be notified of the adoption of the Zoning Bylaw amendment, or of the refusal of a request to amend the official plan and the Zoning Bylaw, you must make a written request to:

The planning committee will receive an information report with respect to the applications at the public meeting, which will be available to the public on the City of Kingston's website at www.CityofKingston.ca/city-hall/committees-boards/planning-committee on August 1, 2015. A comprehensive report will be presented at a future meeting of the planning committee, at which time a recommendation will be made to Council regarding the amendments.

Please note that City council has delegated to the planning committee the authority to hold the public meeting instead of council. All representations, both verbal and written, will be considered only by the planning committee, which will submit a committee report with its recommendations to council for a decision on the matter.

Notice of collection: Personal information collected as a result of this public meeting is collected under the authority of the Municipal Act, the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), the Planning Act, and all other relevant legislation, and will be used to assist in making a decision on this matter. All personal information (as defined by MFIPPA), including (but not limited to) names, addresses, opinions and comments collected will be made available for public disclosure to members of the public, at the meeting, through requests, and through the website of The Corporation of the City of Kingston.
