Notice of Application - New City-Wide Zoning Bylaw

Section 26(9) of the Planning Act requires that all zoning bylaws are amended no later than three years after an Official Plan Update comes into effect to achieve conformity with the Official Plan. Taking into account the anticipated timing of the Five-Year Update to the Official Plan, the introduction of a 2014 Provincial Policy Statement and amendments to the Planning Act, R.S.O. 1990, c. P.13, the City has initiated the completion of a new City-wide Zoning Bylaw to repeal and replace its existing zoning bylaws with one comprehensive bylaw for the City that is consistent with 2014 Provincial Policy Statement and conforms with the updated policies in the Official Plan.

Purpose And Effect of the Proposed Zoning Bylaw

Council of a municipality may, under Section 34 of the Planning Act, pass a zoning bylaw to restrict the use of land and the erection, location and use of buildings and structures. The effect of the new City-wide Zoning Bylaw will be to restrict the use of land and the erection, location and use of buildings and structures within the entire municipality of the City of Kingston. After the bylaw is in force, no land shall be used and no building or structure shall be erected, altered or used in any manner except in conformity with the provisions of the bylaw. The bylaw will not apply to prevent the use of land if such land, building or structure was lawfully used for such purpose on the day of passing of the bylaw, so long as it continues to be used for that purpose. All previous zoning bylaws in effect in the City of Kingston will be repealed and replaced by the new City-wide Zoning Bylaw.

Subject Lands

The new City-wide Zoning Bylaw will affect all lands within the municipal boundary of the City of Kingston. Accordingly, no key map is provided.

Additional Information relating to the proposed new City-wide Zoning Bylaw, including the first draft of the proposed Zoning Bylaw, can be viewed at the office of planning, building and licensing services at 1211 John Counter Blvd., between 8:30 a.m. and 4:30 p.m., Monday to Friday. The document will also be available at www.CityofKingston.ca/NewZoningBylaw.

A statutory open house and statutory public meeting will be scheduled at a later date and further notice regarding the statutory open house and statutory public meeting will be advertised in The Kingston Whig-Standard and sent to any person who has requested in writing to receive further notice.
