Notice of Passing - Development Charge Bylaw by the City of Kingston

Take Notice that the Council of the Corporation of the City of Kingston passed Development Charge (DC) Bylaw No. 2019-116 on the 3rd day of September, 2019 under Section 2 (1) of the Development Charges Act (the Act), 1997, S.O., 1997 c. 27, for Municipal Wide Services (Roads, Public Works, Fire, Police, Transit, Parks and Recreation, Library, Administration Studies, Affordable Housing and Waste Diversion) and Urban Services (Wastewater and Water). 

And Take Notice that any person or organization may appeal to the Local Planning Appeal Tribunal under Section 14 of the Act, in respect of the Development Charge Bylaw No. 2019-116, by filing with the Clerk of the City of Kingston, on or before the 14th day of October, 2019, a Notice of Appeal setting out the objection to the DC Bylaw and the reasons supporting the objection.  An appeal may be filed with the City Clerk, 216 Ontario Street, Kingston, ON, K7L 2Z3.

The DC Bylaw will come into force on September 29th, 2019. The DC Bylaw provides for certain exemptions from the charges, including, but not limited to: industrial uses; lands in designated Community Improvement Areas; intensification of existing and new dwellings; places of worship; agricultural uses; and temporary buildings. The complete Bylaw should be consulted for the complete list of exemptions from the charges.

The schedule of Development Charges imposed by the DC Bylaw that will become effective as of September 29th, 2019 are as follows:

All charges in the table above that will become effective on September 29th, 2019 are subject to annual indexing as of January 1st each year in accordance with the Bylaw provisions.

No Key Map has been provided as the Development Charge is applicable to all lands located within the City of Kingston municipal boundary. The Urban Services charge is applicable to all lands in the City of Kingston that are served by municipal water and/or sanitary sewer services.

A copy of the complete Bylaw is available for examination at the City Clerk's Office between the hours of 8:30 a.m. to 4:30 p.m., Monday to Friday, at 216 Ontario St., Kingston, ON.
