Notice of a Public and Regular Meeting Regarding a Proposed Amendment to the City of Kingston Zoning By-Law No. 76-26 (former Township of Kingston) and Zoning By-Law 97-102 (Cataraqui North former Township of Kingston)

A Public Meeting will be held on Thursday, Nov. 6, 2014 at 6:30 p.m. in Council Chambers, City Hall, 216 Ontario St.

Purpose and Effect of the Application: Administrative Amendment to Zoning By-Law No. 76-26 of the City of Kingston (former Township of Kingston) and Zoning By-Law 97-102 Cataraqui North former Township of Kingston.

The proposed amendments will correct map errors/inconsistencies, typographic errors and text deficiencies identified in these By-Laws, and harmonize the requirements across the municipality as follows:

  • Add a definition for "Bedroom" and "Service Shop, Small Engines";
  • Delete provisions that have not been functioning within the Zoning By-Law or were inserted into the Zoning By-Law in error;
  • Harmonize provisions to similar standards found in other Zoning By-Laws, such as parking for residential uses;
  • Correct for grammar or modify provisions to be more functional;
  • Correct section numbers and headings that are typing errors;
  • Re-establish zone provisions that were inadvertently deleted because of an administrative oversight; and,
  • Re-establish and correct zones within the Zoning By-Law map schedules to recognize existing uses.

Key Map: A key map is not included as this amendment is an Administrative Amendment to By-Law No. 76-26 or 97-102 which applies to all the lands in the former Township of Kingston. There are approximately 20 map changes to Zoning By-Law 76-26 to correct omissions or errors; the maps are available upon request.

*All public meetings are scheduled for 6:30 p.m. The Planning Committee will deal with them in the order in which they appear on the agenda.

Public Consultation

Anyone may attend the public meeting and make a verbal statement, and/or submit comments in writing, either in support of or in opposition to the proposed Zoning By-Law Amendment. The Planning Committee will receive a preliminary information report with respect to the application at the Public Meeting, which will be available to the public on the City of Kingston's website at www.CityofKingston.ca/city-hall/committees-boards/planning-committee on October 31, 2014. The comprehensive report will be presented at the November 6, 2014 meeting of the Planning Committee, at which time a recommendation will be made to Council regarding the amendment.

Please note that City Council has delegated to the Planning Committee the authority to hold the public meeting instead of Council. All representations, both verbal and written, will be considered only by the Planning Committee, which will submit a Committee Report with its recommendations to Council for a decision on the matter.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Kingston before the proposed Zoning By-Law Amendment is passed, the person or public body is not entitled to appeal the decision of the Council of The Corporation of the City of Kingston to the Ontario Municipal Board. If a person or public body does not make oral submissions at a public meeting, or make written submissions to the City of Kingston before the proposed Zoning By-Law Amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to add the person or public body as a party.

All personal information (as defined by MFIPPA), including (but not limited to) names, addresses, opinions and comments collected will be made available for public disclosure to members of the public, at the meeting, through requests, and through the website of The Corporation of the City of Kingston.
