Public Meeting - Planning Committee

Notice of a Public Meeting Regarding a Proposed Amendment to the City of Kingston Official Plan

A Public Meeting will be held on Thursday, March 20, 2014 at 6:30 p.m. in
Council Chambers, City Hall, 216 Ontario Street

Purpose and Effect of the Proposed Amendment: The purpose and effect of the proposed Official Plan Amendment is to add policies that set out the land use framework regarding the potential development of a casino gaming facility in the City of Kingston.

The Ontario Lottery and Gaming Corporation (OLG) has presented its new gaming and lottery modernization plan to municipalities. The OLG has established 29 gaming zones across the province. Kingston is located in gaming zone E3, an area being considered for potential expansion and consolidation efforts by OLG.

City Council passed a motion on October 2, 2012 that both advised the OLG that the private sector could prepare proposals for the OLG process within the boundaries of the City of Kingston; and that as a condition a gaming facility would not be considered in the Central Business District. City Council passed another motion on October 16, 2012 to research and identify zoning setback best practices in gaming industry developments, and in response the Gaming Facility Policy and Regulation Study was prepared. It was presented to Planning Committee on January 17th, 2013. As a consequence of this Study, City Council also directed on February 5, 2013 that the Official Plan be amended.

The proposed Official Plan Amendment will add the casino gaming facility land use to the current provisions of the Official Plan and will provide policy guidance for any proponents contemplating locating a casino gaming facility in Kingston.

Public Consultation

Anyone may attend the public meeting and make a verbal statement, and/or submit comments in writing, either in support of or in opposition to the proposed Official Plan Amendment.  If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Kingston before the proposed Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decision of the Council of the City of Kingston to the Ontario Municipal Board. If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Kingston before the proposed Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to add the person or public body as a party.

The Planning Committee will receive a preliminary information report with respect to the proposed amendment at the Public Meeting, which will be available to the public on the City's website at www.cityofkingston.ca/city-hall/committees-boards/planning-committee on March 15, 2014.

Planning Committee will consider a comprehensive report and recommendation from the Planning and Development Department, respecting the subject application(s), at a future meeting.  The Committee will make its recommendation to City Council at that meeting.  The decision of City Council will be final unless appealed.

All persons who made oral or written submissions, or have requested notification in writing, will be given written notice of the future meeting(s) of Planning Committee at which the subject application(s) will be considered.

Please note that City Council has delegated to the Planning Committee the authority to hold the public meeting instead of Council.  All representations, both verbal and written, will be considered only by the Planning Committee, which will submit a Committee Report with its recommendations to Council for a decision on the matter.
