Public Notice - Notice of application for approval to expropriate land - 612 John Counter Boulevard

July 10, 2018 -

In the matter of an application by The Corporation of the City of Kingston for approval to expropriate land being all of the lands municipally known as 612 John Counter Blvd., being Part of Farm Lot 5, Concession West of the Great Cataraqui River, designated as Parts 1, 2, and 3 on Reference Plan 13R-15182 in the City of Kingston, in the County of Frontenac being all of PIN 36001-0006 (LT), for the purposes of the Third Crossing Bridge project (the "Third Crossing") including for the construction, use, maintenance, and repair of a bridge over the Cataraqui River, the widening of John Counter Boulevard, and works ancillary thereto.

Notice is hereby given that application has been made for approval to expropriate the land described as follows:

All right, title and interest (fee simple) in the lands municipally known as 612 John Counter Boulevard, being Part of Farm Lot 5, Concession West of the Great Cataraqui River, designated as Parts 1, 2 and 3 on Reference Plan 13R-15182 in the City of Kingston, County of Frontenac, being all of PIN 36001-0006 (LT)

Any owner of land in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing,

  1. In the case of a registered owner, served personally or by registered mail, within thirty (30) days after the registered owner is served with the notice, or when the registered owner is served by publication, within thirty (30) days after the first publication of the notice;
  2. In the case of an owner who is not a registered owner, within thirty (30) days after the first publication of the notice.

The approving authority is The Council of the Corporation of the City of Kingston, 216 Ontario Street, Kingston, Ontario, K7L 2Z3.
