We have received questions seeking clarification on the OMB pre-hearings for Official Plan appeals, set for November 23, 2017; this blog post aims to provide information to clarify.
Official Plan Update
The City’s Official Plan serves as the blueprint for how the City will grow over the next 20 years. An Official Plan Update is required every 5 years by legislation, this helps to keep the document current on an ongoing basis.
The Official Plan update came into effect on Aug. 29, 2017, with the exception of matters appealed to the Ontario Municipal Board (OMB).
The Official Plan Update completed by the City includes policies to provide more emphasis on built form and built environment to ensure greater compatibility for residential infill projects. Stable areas and high density residential areas policies are also included in the update.
Official Plan appeals
Five appeals were made against the City’s Official Plan Update, however, there were no “global” appeals to the Official Plan meaning that none of the five appeals affect the entirety of the Plan. As such, any policy amendment that is not subject to an appeal is now in full force and effect.
Report Number 17-258, presented to Council on September 19, 2017, provides details pertaining to the five appeals against the City’s Official Plan. A copy of the Report can be found here

The OMB pre-hearing for the five appeals is intended to scope the issues to be reviewed by the Board while also confirming administrative details such as the anticipated start date and length of the hearing. In addition, the pre-hearing allows for members of the public to request “party” or “participant” status (for descriptions of “party” and “participant” please see my November 8 blog post called “Clarifying the OMB process”
