null Notice of adoption of an Official Plan amendment and notice of passing of a Zoning Bylaw amendment by The Corporation of the City of Kingston
October 20, 2015 –
The Council of The Corporation of the City of Kingston passed Bylaw No. 2015-180, "A bylaw to amend the Official Plan for the City of Kingston (Amendment Number 37, Williamsville Main Street)" and Bylaw Number 2015-181, "A bylaw to amend Bylaw Number 8499, ‘Restricted Area (Zoning) Bylawfor The Corporation of the City of Kingston', as amended, for administrative amendments to the Williamsville Main Street and to permit surface parking lots in the (C4) Williamsville Main Street Commercial Zone as a temporary use for a period of three years" on the 6th day of October, 2015.
Purpose and effect of the bylaws: To correct the boundary of the Williamsville Main Street shown on Schedule PS-1 of the Official Plan, and to permit surface parking facilities on properties within the Williamsville Main Street as a temporary use.
There was an error in the boundary of the Williamsville Main Street Special Policy Area shown on Schedule PS-1, adopted through Official Plan Amendment Number 21 (OPA 21) by Bylaw Number 2013-147 on July 17, 2013. This is an administrative amendment to correct the boundary line, as originally intended in the 2013 adoption of OPA 21 for the Williamsville Main Street (refer to the key map), and as detailed in the Williamsville Main Street Study.
In addition, the City is proposing an amendment to the Williamsville Main Street Special Policy Area in Section 10E of the Official Plan, and a corresponding amendment to Zoning Bylaw Number 8499, to permit surface parking facilities as a short-term temporary use within the Williamsville Main Street. These changes will allow surface parking for ongoing redevelopment along the Williamsville Main Street, and will provide time for the City to complete an overall parking strategy for the area, without altering the long-term pedestrian oriented vision of the Williamsville Main Street.
Additional administrative amendments to Zoning Bylaw Number 8499 for the Williamsville Main Street included re-numbering the C4 Zone in Section 23C of the Zoning Bylaw, and including a reference to the C4 Zone in Section 5.3 of the General Provisions of the Zoning Bylaw regarding parking provisions.
Area affected and key map: The area affected is Williamsville Main Street, the 1.7 km portion of Princess Street between Division Street and Bath Road/Concession Street. A key map is provided with this notice that shows the area where the Official Plan amendment and Zoning Bylaw amendment for the Williamsville Main Street apply.
And take notice that bylaws number 2015-180 and 2015-181, and information respecting said bylaws and the amendments to the Official Plan and Zoning Bylaw Number 8499, are available from planning, building and licensing services, 1211 John Counter Blvd., Kingston, Ontario, during regular office hours (8:30 a.m. to 4:30 p.m.) or by calling Sonya Bolton, senior planner, at 613-546-4291, ext. 3237.
And take notice that any person or agency may appeal to the Ontario Municipal Board in respect of the bylaws by filing with the clerk of The Corporation of the City of Kingston, 216 Ontario St., Kingston, ON K7L 2Z3, not later than 4:30 p.m. on the 9th day of November, 2015, a Notice of Appeal setting out the objection to the bylaws, the specific part of the Official Plan amendment and/or Zoning Bylaw amendment to which the appeal applies, and the reasons in support of the objection. Any appeal submitted to the City of Kingston for referral to the Ontario Municipal Board must be accompanied by a fee payment in the amount of $125.00 payable to the Minister of Finance.
And take notice that the Official Plan amendment and Zoning Bylaw amendment are exempt from approval by the Minister of Municipal Affairs and Housing. The decision of the council is final if a Notice of Appeal is not received on or before the last day for filing a Notice of Appeal.
Only individuals, corporations or public bodies may appeal a decision of the municipality to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaws were passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
There are a number of other site-specific development applications for properties within the Williamsville Main Street; however, the overall Williamsville Main Street Special Policy Area and the Williamsville Main Street (C4) Commercial Zone are not currently the subject of any other area-wide applications under the Planning Act. Note: The last day for filing objections will be Monday, November 9, 2015. The objection must be received no later than 4:30 p.m. on this date in order to be valid.
