Notice of Passing - Zoning Bylaw 2015-56 by the Corporation of the City of Kingston

The council of the Corporation of the City of Kingston passed Bylaw Number 2015-56, "A bylaw to amend Bylaw No. 76-26 ‘A bylaw to regulate the use of lands and the character, location and use of buildings and structures in the township of Kingston' (administrative amendments)" on the 25th day of March, 2015, under section 34 of the Planning Act, R.S.O. 1990, as amended.

And take notice that any person or agency may appeal to the Ontario Municipal Board in respect of the Bylaw by filing with the clerk of the Corporation of the City of Kingston not later than the 20th day of April, 2015, a notice of appeal setting out the objection to the bylaw and the reasons in support of the objection. The objection must be accompanied by the fee required by the Ontario Municipal Board.

Only individuals, corporations and public bodies may appeal a Zoning Bylaw to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

An explanation of the purpose and effect of the bylaw, describing the lands to which the bylaw applies, and a key map showing the location of the lands to which the bylaw applies are attached.

Note: The last day for filing objections will be April 20. The objection must be received by 4:30 p.m. at the Office of the Clerk, City Hall, 216 Ontario Street, by this date in order to be valid.

Any appeal submitted to the City of Kingston for referral to the Ontario Municipal Board must include the following:

  1. The objection to the bylaw and the reasons in support of the objection;
  2. The name and address of the appellant; and,
  3. The fee required by the Ontario Municipal Board in the amount of $125 payable to the
  4. Minister of Finance, Province of Ontario.

Explanatory note concerning Bylaw Number 2015-56

Area affected: The amendments are primarily text changes that do not affect any particular area of the City. There are approximately 20 map changes to correct omissions and line errors. The maps schedules identifying the areas are attached to the by-law.

Purpose: The proposed amendments will correct map errors/inconsistencies, typographic errors and text deficiencies identified in these bylaws, and to harmonize the requirements across the municipality as follows:

  • Add a definition for "Bedroom" and "Service Shop, Small Engines";
  • Delete provisions that have not been functioning within the Zoning Bylaw or were inserted into the Zoning Bylaw in error;
  • Harmonizing provisions to similar standards found in other Zoning Bylaws, such as parking for residential uses;
  • Correct for grammar or modifying provisions to be more functional;
  • Correct section numbers and headings that are typing errors;
  • Re-establish zone provisions that were inadvertently deleted because of an administrative oversight; and,
  • Re-establish and correct zones within the Zoning Bylaw map schedules to recognize existing uses.

Effect: The changes are not intended to alter the effect of the Zoning Bylaw but to clarify, standardize and correct errors.

Key map: A key map is not included as this amendment is an administrative amendment to Bylaw No. 76-26 the text changes applies to all the lands covered by the bylaw. There are approximately 20 map changes to Zoning Bylaw 76-26 to correct omissions or errors;
