Notice of a complete application and public meeting regarding a proposed amendment to the five main zoning bylaws
A public meeting will be held on Thursday, March 31, 2016 at 6:30 p.m. in Council Chambers, City Hall, 216 Ontario St.

Purpose and effect of the application:
To amend Zoning Bylaw numbers 8499 (former City of Kingston), 96-259 (Downtown and Harbour Zoning Bylaw), 76-26 (former Township of Kingston), 97-102 (Cataraqui North Zoning Bylaw), and 32-74 (former Township of Pittsburgh) to include the following definition of a "Casino Gaming Facility":
"Casino Gaming Facility means any building developed and used for the purpose of providing slot machine or table game wagering or betting, authorized and licensed by the Province of Ontario."
By including the definition of a casino gaming facility in the zoning bylaws, it will make this use distinctive from all other types of entertainment, recreational and/or commercial uses. A casino gaming facility will not be listed as a permitted use in any of the zones in any of the bylaws; therefore, if someone wishes to propose a casino gaming facility, they will be required to submit an application for a site-specific Zoning Bylaw amendment. The proposed Zoning Bylaw amendment and approach is consistent with the Official Plan policies regarding casino gaming facilities, which were approved through settlement by the Ontario Municipal Board on November 10, 2015 (case number PL140920).
This is a City-wide amendment only affecting the definitions section (text) of each of the main zoning bylaws; therefore no key map is provided with this notice.

Anyone may attend the public meeting and make a verbal statement, and/or submit comments in writing, either in support of or in opposition to the proposed Zoning Bylaw amendment. If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Kingston before the bylaw is passed, the person or public body is not entitled to appeal the decision of the council of The Corporation of the City of Kingston to the Ontario Municipal Board. If a person or public body does not make oral submissions at a public meeting, or make written submissions to the City of Kingston before the bylaw is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the board, there are reasonable grounds to do so.

The planning committee will receive a preliminary information report with respect to the proposed amendment at the public meeting, which will be available to the public on the City of Kingston's website at www.CityofKingston.ca/city-hall/committees-boards/planning-committee on March 26, 2016. A comprehensive report will be presented at a future meeting of the planning committee, at which time a recommendation will be made to council regarding the proposed amendment.
Please note that city council has delegated to the planning committee the authority to hold the public meeting instead of council. All representations, both verbal and written, will be considered only by the planning committee, which will submit a committee report with its recommendations to council for a decision on the matter.
Notice of collection – Personal information collected as a result of this public meeting is collected under the authority of the Municipal Act, the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), the Planning Act, and all other relevant legislation, and will be used to assist in making a decision on this matter. All personal information (as defined by MFIPPA), including (but not limited to) names, addresses, opinions and comments collected will be made available for public disclosure to members of the public, at the meeting, through requests, and through the website of The Corporation of the City of Kingston.
